Rieke:Workers' Protection in Malaysia Limited

VIVAnews – Lawmaker Rieke Dyah Pitaloka said that the amendment of MoU of the Indonesian Migrant Workers (TKI) in 2011 is not yet enough to protecting the workers.

“Judging by the content of the revised MoU, it’s as if the protection of Indonesian domestic workers overseas has been done. But when examined more closely, the MoU can't still protect these workers due to the uncertain control mechanisms and law enforcement of the revised MoU’s clauses,” said Rieke to VIVAnews on Tuesday.

Furthermore, she revealed several sections in the revised MoU that must be addressed, including:

First, unclear control mechanism. Although a Joint Task Force has been set up, it has limited work. Article 13 of the revised MoU stated that the establishment and function of the JTF is mentioned in the terms of reference agreed by related parties. “This means that JTF may be unable to handle issues on Indonesian migrant workers,” said Rieke. 

Second, weak law enforcement. The MoU did not mention about the sanction mechanism. In Malaysia, prior to the annulment of the Indonesian workers’ moratorium, there were 247 agencies that had tried to monopolize the work migration process that is not according to the agreement.

Based on the data and facts above, Rieke recommended that the government, namely the Ministry of Manpower and Transmigration, the Ministry of Foreign Affairs, and BNP2TKI, to review the annulment of Indonesian workers’ moratorium to Malaysia. 

Rieke asserted that the Indonesia-Malaysia MoU should not just aim at putting an end to the moratorium. 

“This MoU should provide maximum protection to the Indonesian workers and penalize those who violate it,” she said.  

Earlier, Minister of Manpower and Transmigration, Muhaimin Iskandar, said that the Indonesian workers’ employment moratorium period is used by the government to improve the internal organization of Indonesian workers.
