Minister Questions Suitors of Section 6A

VIVAnews - Minister of Justice and Human Rights, Amir Syamsuddin, questioned the reasons presented by various parties planning to sue Law on 2012 Revised State Budget Article 7 point 6a which specifies on the pricing of subsidized fuel. The section was ratified by lawmakers on 31 March 2012.

Article 7 point 6a says, "Should the average Indonesia Crude Price (ICP) either increase or decrease by 15 percent within the period of six months, the government can review subsidized fuel prices and issue any supporting policy."  

"Is there anything wrong with the law? There is the principle of beneficence in the law," said Amir on Monday.

Amir said the article was prepared during an exceptional condition. 

Amir did not answer when asked if the result of the plenary meeting at the House of Representatives (DPR) office was constitutional.

So far, several parties stated that a judicial review on the article will be filed to the Constitutional Court. Former Justice and Human Rights Minister Yusril Ihza Mahendra was among the suitors. 

In his opinion, despite the delay in fuel price rise as per 1 April 2012, the government is still authorized to increase or decrease subsidized fuel prices any time within six months should the average ICP reaches 15 percent. 

He also said the article of Law on Revised State Budget does not stipulate any legal certainty as specified in Article 28D point 1 of the 1945 Constitution.
